Somalia-born man charged with alleged visa breaches in Victoria

A Somalia-born man has appeared before the Melbourne Magistrates Court today (27 May, 2025), charged with allegedly failing to comply with his visa-mandated conditions.

The AFP charged the man, 43, today, after locating him in Melbourne.

It will be alleged the man breached the conditions of his Commonwealth visa by failing to maintain and wear his electronic monitoring device.

The man has been charged with:

  • Two counts of failing to ensure an electronic monitoring device remains in good working order, contrary to section 76D(3) of the Migration Act 1958 (Cth); and
  • One count of failing to allow an authorised officer to fit an electronic monitoring device, contrary to section 76D(2) of the Migration Act 1958 (Cth).

These offences each carry a maximum penalty of five years’ imprisonment and/or a $93,900 fine.

He was granted bail to reappear in court at a later date.
