Afghanistan-born man charged with two alleged visa breaches in NSW

An Afghanistan-born man is set to appear before Burwood local Court today (7 July, 2025) charged with allegedly failing to comply with his visa-mandated conditions. 

The AFP charged the man, 34, on Sunday, 6 July, 2025, after he was located in Sydney. 

It will be alleged in court the man breached two of the conditions of his Commonwealth visa relating to maintaining his monitoring device in good working order. 

The man has been charged with: 

  • One count of failing to ensure a monitoring device remains in good working order, contrary to Section 76D(3) of the Migration Act 1958 (Cth); and
  • One count of failing to notify an authorised officer as soon as practicable upon becoming aware that their monitoring device is not in good working order, contrary to Section 76D(4) of the Migration Act 1958 (Cth)

These offences each carry a maximum penalty of five years’ imprisonment and/or a $99,000 fine.
