Afghanistan-born man charged with two alleged visa breaches in NSW

An Afghanistan-born man is set to appear before the John Maddison Tower Court today (31 July, 2025) charged with allegedly failing to comply with his visa-mandated curfew conditions. 

The AFP charged the man, 31, yesterday (30 July, 2025), after he was located in Sydney.

It will be alleged the man breached two of the conditions of his Commonwealth visa by failing to observe his residential curfew and exclusion zone obligations. 

The man has been charged with: 

  • One count of failing to comply with a curfew condition, contrary to section 76C(1) of the Migration Act 1958 (Cth); and
  • One count of failing to comply with a requirement not to go within certain distance of a school, contrary to section 76DAB(1) of the Migration Act 1958 (Cth).

These offences carry a maximum penalty of five years’ imprisonment and/or a $99,000 fine for each offence.
