Man in Victoria charged with alleged visa breach and committing offences whilst on bail
A Sudanese-born, man, 45, is expected to appear in the Melbourne Magistrates' Court tomorrow (27 January, 2024) charged with allegedly failing to comply with a curfew, failing to maintain a monitoring device and committing indictable offences whilst on bail.
The AFP, with the assistance of Victoria Police, arrested and charged the man today (26 January, 2024).
It will be alleged the man breached conditions of his Commonwealth visa by failing to observe his residential curfew obligations and failing to maintain his monitoring device. The man was on bail for the same offences when the alleged breaches occurred.
The man has been charged with:
- one count of failing to comply with a curfew condition, contrary to section 76C(1) of the Migration Act 1958 (Cth). This offence carries a maximum penalty of 5 years’ imprisonment and a $93,900 fine;
- one count of failing to ensure that the holder’s monitoring device remains in good working order, contrary to 76D(3) of the Migration Act 1958 (Cth). This offence carries a maximum penalty of 5 years’ imprisonment and a $93,900 fine; and
- two counts of committing an indictable offence whilst on bail, contrary to Section 30(b) of the Bail Act 1977 (Vic). These offences carry a maximum penalty of 3 months’ imprisonment and a $4,000 fine.
