Somali-born man charged over alleged visa breaches in Victoria
A Somali-born man is set to appear before Melbourne Magistrates’ Court today (2 October, 2025) charged after allegedly failing to comply with his visa-mandated conditions.
The AFP charged the man, 44, yesterday (1 October, 2025), after he was located in Ascot Vale, Victoria.
It will be alleged the man breached one of the conditions of his Commonwealth visa by failing to ensure his electronic monitoring device was in good working condition.
The man has been charged with:
- Two counts of failing to comply with a curfew condition, contrary to section 76D(3) of the Migration Act 1958 (Cth). The maximum penalty for this offence is five years’ imprisonment and/or a $99,000 fine;
- One count commit an indictable offence whilst on bail, contrary to section 30B Bail Act 1977 (Vic). The maximum penalty for this offence is three months’ imprisonment and/or a $9,900 fine; and
- One count contravene conduct conditions of bail, contrary to section 49F Summary Offences Act 1966 (Vic). The maximum penalty for this offence is three months’ imprisonment and/or a $9,900 fine.
