Sudan-born man charged over three alleged visa breaches in Victoria
A Sudan-born man has appeared before the Melbourne Magistrates’ Court charged with allegedly failing to comply with his visa-mandated conditions.
The AFP charged the man, 28, on 8 September, 2025, after he was located in Melbourne.
It will be alleged the man breached two of the conditions of his Commonwealth visa by failing to observe his residential curfew obligations and being within a certain distance of a school.
The man has been charged with:
- Two counts of failing to comply with a curfew condition, contrary to section 76C(1) of the Migration Act 1958 (Cth);
- One count of failing to comply with a requirement not to go within a certain distance of a school, contrary to section 76DAB(1) of the Migration Act 1958 (Cth).
- Three counts of committing an indictable offence whilst on bail, contrary to section 30B of the Bail Act 1977 (Vic). This offence carries a maximum penalty of three months’ imprisonment and/or a $6105.30 fine; and
- Three counts of contravening a conduct condition of bail, contrary to section 49F of the Summary Offences Act 1966 (Vic). This offence carries a maximum penalty of three months’ imprisonment and/or a $6105.30 fine.
The Migration Act offences carry a maximum penalty of five years’ imprisonment and/or a $99,000 fine for each offence.
